Solicitation of prostitution is when an individual agrees to give a person money or valuables in exchange for sex, which is typically followed by an arrangement of where the sexual act will take place. California Penal Code Section 266 (e) states that any individual who exchanges money or goods in exchange for a person to perform sexual acts is guilty of a felony. The State has recently enacted various laws to deter prostitution and the solicitation of prostitutes. One of these recent laws includes Los Angeles Municipal Code Section 41.70, which states that the vehicle of any person who solicits or tries to solicit a prostitute will be seized and forfeited, due to involvement in illegal activities. There are many situations which can place a person in an awkward position when it comes to solicitation laws. For example, simply being in the wrong place at the wrong time may place an innocent person at risk for a solicitation arrest. The alleged "John" and alleged prostitute will both be arrested and charged with committing various sex - related crimes. Another example of an unreasonable solicitation arrest is when a person is tricked by the police in a sting operation. A sting operation is when a law enforcement agent goes undercover by posing as a prostitute. When an innocent person talks to the undercover agent, the person is arrested for solicitation of a prostitute.
